Terms and Conditions

Definitions 

"We/Us" means Fridgerate Solutions, Fridgerate.co.uk

Office: Valley Barn, Hawerland, Colaton Raleigh, Sidmouth, Devon, EX10 0JA

"You" means the Customer whose details are on the Booking Form

For "Equipment" "Price", "Site" "Event", and "Deposit" see the Booking Form.

Before the Trailers or Units are deliver You will :

Pay the Full Amount in accordance with the Booking Form. If you pay late then you will pay interest from the date of required payment until actual payment at 4% a year above the base rate of NatWest Plc.

 

We Will (subject to your obligations below):

Deliver and install the Equipment on or before the Event. Dismantle and remove the Equipment from the Site promptly after the Event.

 

For Installation & Removal and during the Event You will:

Provide a firm and level site of turf or hard standing with access and hard-standing for commercial vehicles for delivery, installation and removal between 0800 hrs to 1800 hrs.

Be responsible for identifying and reporting any damage to the trailer at the start of the hire period that may reflect as damage caused during the hire period.

Be responsible for and reimburse us for any loss or damage to Equipment, unless caused by us.

You will only be responsible for any loss or damage to the Equipment resulting from any actions outside the terms of that cover.

Report any damage or loss to us promptly and if caused by a suspected crime also to the Police

 

Cleaning

Excessive cleaning will be charged for at rate of 20% of the total hire price. Excessive cleaning applies when the “Equipment” i.e. racking, floors, walls or ceiling are excessively covered in food stuffs/fats/oils. Such “food stuffs/fats/oils” will have to be cleaned with special solutions or hot wash to disinfect and clean the internal surfaces of the trailer and racking system, therefore returning the trailer to original condition at the start of the hire period. Muddy floors, surfaces and liquid spillage are all acceptable as per normal use of the trailer. Spots of food here and there are also acceptable.

 

Damages

The trailer must be returned in the condition that it was received. Any damages found on the trailer when first received must be noted on the delivery slip and signed off by both the delivery driver and “you” the customer. A photographic copy of this delivery slip can be requested in writing by email.

Any new damages incurred during the hire period will be billed for at cost. For hires where a damage deposit has been paid, damages will be billed for at “cost” if beyond the value of the deposit amount already paid. All damaged deposits will be refundable upon inspection of the “equipment” after the hire period.

 

Variations

If you want to change anything from the details shown on the Booking Form you must let us know in advance. If we can provide what you want we will tell you how much it will cost and ask you confirm your agreement to that. We are not obliged to agree any variation. We are only bound by any variation once we have your agreement in writing (which can include email). Any variation will be subject to these Terms & Conditions.

If you do not comply with your obligations above Before the Event We shall be entitled to add to the Price a reasonable figure for additional costs or labour or materials which we incur as a consequence plus 20% and, if we are unable to remove the Equipment, hire charges at the daily rate until we can, which You must pay within 7 days of notification.

 

Cancellation 

You can cancel without penalty by writing to us by post, email or fax to arrive within seven days from the date you sign the Booking Form.

If You cancel within seven days We shall refund to You anything you have paid to us.

After that if You cancel You must pay us the following which are a reasonable estimate of our likely losses:

If you cancel within 90 days of the Event – 20% of the total price excluding the deposit

If you cancel within 30 days of the Event – 50% of the total price excluding the deposit

If you cancel within 14 days of the Event – 65% of the total price excluding the deposit

If you cancel within 7 days of the Event – 80% of the total price excluding the deposit

You may wish to take out insurance cover against cancellation.

We will use our best endeavours to supply you with the Equipment ordered but where this is not possible we will notify you as soon as possible of any alteration. You are not entitled to cancel if the alteration is necessary to comply with safety or other legal requirements, or does not materially affect what we will supply. If the alteration for any other reason and fundamentally different from the Equipment on the Booking Form you may terminate this contract and any Deposit paid will be refunded.

 

Limits on Our Liability 

We will use reasonable skill and care in installation and removal, and take reasonable care to avoid damage to Your property, though you must appreciate that some damage is inevitable. The Price does not include making good or repairs to the Site unless caused by our negligence or breach of contract.

If the Equipment cannot be installed because of adverse weather or other circumstances beyond our control, our liability shall be limited to return of any money You have paid. You may wish to take out insurance cover against cancellation.

We are not liable for your property used or stored in our refrigerated trailers or units.

We are not liable for breach of contract to anyone other than You.

Unless covered by the next clause or expressly accepted in these Terms & Conditions We shall have no liability to You for any indirect or consequential loss (including loss of goodwill, loss of custom and loss of profit).

We do not exclude or limit our liability to You for;

Death or personal injury arising from Our negligence,

Loss or damage caused by fraud by Us,

Any liability We have to you under consumer protection legislation that cannot be excluded or limited.

Delivery, Setup and Placement

Delivery prices are determined on a Price On Application (POA) basis. Discounted rates may be available for long term hire dependant on location.

Fridgerate.co.uk reserves the right to remove the refrigerated trailer or unit on loan from the hire location if the customer fails to meet the payment terms specified in the quotation.

If possible the trailer must be sited on a flat, level hard standing base provided by the customer. If the trailer is to be situated in a building or marquee, then adequate ventilation must be available to maintain an ambient temperature of no more than 22 degrees centigrade.

The mains power socket must not be more than 12 metres from the unit using a 13 amp cable or 25 metres from the unit using a 16 amp cable. Failure to observe this condition may result in damage to the unit which will be charged to the hirer.

The trailer must not be towed or moved without prior consent from Fridgerate.co.uk. All trailers are fitted with anti-theft devices at the time of delivery. Any loss or damage of these items will be charged for. Keys at £5.50. Wheel clamp at £115.00. Hitch locks at £85.00. All prices are NOT subject to VAT.

We do not insure hirers to tow our trailers. If you have our consent to move a refrigerated trailer, please ensure you have fully comprehensive insurance to tow a trailer. Documentary proof will be required.

Hire Period

The period of hire commences from the day the refrigerated trailer or unit leaves our premises and continues until the unit is off-hired back into our premises.

We offer standard rental periods for short term hire and bespoke timeframes for longterm hire and commercial customers.

Weekday Hire (Monday am- Thursday am)

3 day Weekend Hire (Friday am-Monday am) 

4 day Weekend Hire (Thursday am- Monday am)

5-7 day Weekly hire (Monday am - Monday am)

 

Pricing and Payment

All payments shall be made by BACS within the time frame designated.

An initial payment shall be made as a deposit to book the trailer, with final payments made closer to the date of requirement. 

Fridgerate.co.uk reserves the right to charge 4% over bank rate on all overdue accounts. The customer is responsible for all accidental damage and will cover all consequential losses as a result. The hirer shall also indemnify in respect of all claims any reason whatsoever for injuries to persons or damage to property caused by, or in conjunction with, or arising from the refrigeration and/or associated equipment and in respect of all costs and charges in connection herewith.

Whilst every effort is made to provide the customer with refrigeration equipment as quoted on the day and time requested, Fridgerate.co.uk cannot be held responsible for delays due to incidents beyond our control i.e. Non payment of accounts, serious traffic delays, breakdown of delivery vehicle, inclement weather or Acts of God.

Customer Requirements

The customer must:

Maintain the refrigerated trailer or unit and its associated equipment in the condition in which it was delivered.

Maintain regular cleaning rotas as per environmental health regulations.

If the unit is returned in a dirty condition then a minimum £50.00 steam cleaning/disinfecting charge will be made.

General, Usage

Under no circumstances is the hirer allowed to:-

Alter or modify the unit and its associated equipment.
Remove any machinery parts/cables etc.
Deny access to Frigate.co.uk.
Sub-let, re-hire, or sell the unit or its associated equipment. Store illegal or hazardous substances in the unit.

All units are cleaned and inspected prior to the date of hire. The hirer must monitor the temperature on a regular basis and any significant change should be notified to Fridgerate.co.uk immediately.
